* We are a Hong Kong company and our global online auctions take place on a server in Hong Kong where there is no indirect tax. F.A.B. does not charge VAT, GST or Sales Tax on its service charges in any jurisdictions, except for when the Lot is located in China or India unless otherwise stated. We are also exempt of copyright fees and artist’s resale royalty. ** The proceeds of sale due to sellers is safely held in trust by a third party institutional escrow service provider.

5% BUYER’S PREMIUM /

F.A.B. has applied digital technology to the old traditional auction business model and vastly reduced the spiralling costs of bricks and mortar, labour and printing. The F.A.B. Buyer’s Premium is 80% less than the Buyer’s Premium charged by most traditional auction houses. And that does not include the savings from the F.A.B. exemptions for VAT, GST, S/T & Resale Royalty.

We are delighted to pass on these savings to you, our valued customers.

The Buyer’s Premium is a percentage charged on the hammer price (winning bid at the auction) of the Lot and paid for by the buyer.

F.A.B. GUARANTEE /

The F.A.B. Guarantee provides buyers with a six-year warranty regarding the Lot, its authenticity, good title and any condition report unless otherwise stated in the Lot Detail or elsewhere on the website. This warranty is underwritten by our policy (PI) with Lloyds of London and is subject to the F.A.B.

F.A.B. has engaged highly experienced and respected Consultant Specialists located around the world. The specialists are responsible for providing scholarship and for conducting due diligence on all artworks offered for sale by F.A.B. Once a lot is consigned, it is collected from the Seller and delivered to our nearest secure facility. Our specialists then physically inspect the Lot and compile the full catalogue description.

We check the history of ownership and the status of the seller. Each lot is checked with the third-party service provider, Art Recovery International, to determine or confirm good title.

SAFETY + SECURITY /

IT HAS NEVER BEEN SAFER TO SELL AND BUY AT AUCTION

Funds Held in Escrow / After the auction, the proceeds from the sale are held in the account of an Institutional third-party escrow service provider. F.A.B. settles with the seller within 30 days from the auction.

Very few traditional auction houses operate a trust or an escrow account leaving sellers and buyers vulnerable. We strongly believe in this escrow concept as it provides both sellers and buyers with a higher level of financial security.

Six Year Warranty / F.A.B. guarantees its basic catalogue descriptions & condition reports for six years from the date of the auction. These warranties are underwritten by our insurers, Lloyds of London. Our experienced specialists are responsible for cataloguing, research and conducting due diligence where necessary.

Chandelier Bidding / F.A.B. rejects unethical practices often seen at traditional auctions such as “chandelier bidding”. This practice is where the auctioneer indicates bid increments that are false to create a false impression to genuine bidders. In F.A.B.’s opinion this behaviour is misleading and deceptive. At a F.A.B. online auction the bidding automatically starts at 50% of the lower estimate. Every subsequent bid is a genuine bid from real bidders. This is a F.A.B. Guarantee.

Results / We publish our sale results during the auction in real time. We do not provide our sale results to any third party including auction results aggregators

Location of Auction / An auction takes place where and when the hammer falls. We are a Hong Kong company and the fall of the hammer occurs on our server in Hong Kong.

Full Disclosure / If F.A.B. has an interest in a lot, we will declare that interest on the Lot Detail page. F.A.B. will never provide a bidder with any special terms that are not available to every other bidder. The above is stated in accordance with the Terms and Conditions of Business.

Upcoming Auctions / Details of our upcoming auctions are displayed in the auction calendar under AUCTIONS in the tool bar.

ALL TAX EXEMPT @ F.A.B. /

VAT, SALES TAX, GST, ARTIST'S RESALE ROYALTY & COPYRIGHT FEES

These are all exempt at Fine Art Bourse Limited (F.A.B.) as we are a Hong Kong company where there are no indirect taxes. Our transaction charges, therefore, are not subject to indirect taxation (VAT, Sales Tax or GST) with some exceptions including when the goods are located in our premises in China or India.

Furthermore, artist’s resale royalty (Droit de Suite) and copyright fees are also exempt in Hong Kong.

Any variations to the above will be the subject of a SALEROOM NOTICE published in the LOT DETAIL of a LOT in the CATALOGUE.

HOW DOES IT WORK? /

F.A.B. is a new and totally unique online only auction house. We charge 5% Buyer’s Premium. We deliver to you, the buyer, free of charge

There are no other online fine art auctions quite like F.A.B. We take possession of the goods from the Seller prior to the auction so that we can complete due diligence on both the items and their owners.

We provide the buyers with warranties. Artworks at F.A.B. auctions are mostly privately owned and remain located in the country in which they have been sourced until they are delivered to the buyers after the auction (free of charge).

Step 1 / NEW CUSTOMER?

Anyone can anonymously navigate around the site. Sellers may obtain a free auction estimate. Anyone may inspect any lot and/or attend an online auction at any time without joining F.A.B or registering. It is free and without obligation.

Step 2 / JOIN/REGISTER

If you wish to receive Important Announcements then you must first JOIN.

If you wish to leave an ABSETEE BID, TELEPHONE BID or BID ONLINE during an auction you must first JOIN and then REGISTER. You are only required to JOIN once. However, bidders are required to REGISTER before each auction.

Step 3 / BIDDING

All bidders must REGISTER to bid at their earliest convenience. F.A.B. will accept registrations up to 60 minutes prior to the commencement of an auction but no later.

If you are a successful buyer you are bound at law and by the F.A.B. Terms & Conditions of Business to settle your account within 48 hours of the auction. Buying at an auction is a serious business. If a Bidder does not settle within 48 hours from the auction, then subject to instructions from the Seller F.A.B. may commence legal proceedings against the bidder in the courts of Hong Kong and/or in other jurisdictions.

Phone Bidding

You may bid by phone. You simply complete a form after having first registered. F.A.B. staff will contact you by telephone several lots before your lot of interest comes up at the auction.

Absentee Bidding

You may leave an ABSENTEE BID by completing a simple form having first JOINED. At F.A.B. your ABSENTEE BID is encrypted and remains totally secret from all our staff unlike at a traditional auction house where corruption in relation to ABSENTEE BIDS can occur. Our unique software will automatically bid on your behalf subject to any other bids or a reserve if applicable. In many cases your winning ABSENTEE BID will be far less than your limit and/or less than the pre-auction Estimate.

You are welcome to leave an ABSENTEE BID and at the same time register to bid online if you wish.

Online Bidding

We have created a new digital auction platform providing a unique customer experience. The auctions take place in real time commencing promptly at the times and dates advised in the AUCTION calendar. When you Register to bid, you are allocated a digital bidding paddle with your own buyer number. You can then LOGIN, attend the auction and bid by clicking on one of the three bid increment options. Your bid is immediately shown in the Bid History in US Dollars. The Currency Converter shows your bid converted to numerous alternative currencies based on the exchange rates of the day and subject to the Terms & Conditions of Business.

Step 4 / THE AUCTION

The F.A.B. auction platform is unique. The customer experience is unique.

Each auction starts at the advertised time and date referred to in the Auction Calendar found at the AUCTION link on the tool bar. A human caller will call out the bids at the auction.

Bidders must bid during the bidding window. Each lot has a bidding window of 30 seconds. However, if there is a bid within the last 5 seconds of the bidding window then the so-called window is automatically extended for a further 15 seconds and so on. Once the bidding has come to an end the hammer falls with one of three outcomes:

1. BLANK / means that there was no bid.

2. REFER TO SELLER / means that the highest bid is below the reserve and that F.A.B. staff will refer the highest bid to the Seller after the auction and seek instructions as to whether to accept the highest bid or negotiate further.

3. SOLD / The sound of a hammer falling will be heard followed by the appearance of the SOLD popup. This means that the lot is sold for the highest bid to the Buyer recorded as the last paddle number appearing in the Bid History.

The following information is available to the viewer during the auction:

How many people viewed each Lot, how many people are watching the auction, the sound of a caller, currency converter, bidding window countdown, three different bid increments (high bid, medium bid, low bid), the current bid, bid history, results in real time, image of the Lot, thumb nail images of the previous Lots, present Lot and next Lots

Viewing

There may be a viewing period when interested buyers can inspect some or all the Lots in an auction at agreed locations locally and/or internationally subject to the size and value of the Lots. This viewing information will be available at the Auction Calendar accessed at AUCTIONS on the tool bar or within a LOT DETAIL.
